Terms of Service

1. Parties and Acceptance
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Fly Alerts LLC, a Wyoming limited liability company ("FlyAlerts," "Company," "we," "us," or "our"), with its principal office at 75 E 3rd St, Ste 7, Sheridan, WY 82801.
By accessing our website at fly-alerts.com, creating an account, or purchasing our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, our Cookie Policy, our Refund Policy, and our Disclaimer, all of which are incorporated herein by reference.
2. Nature of Service
2.1 What FlyAlerts Is
FlyAlerts is a software-as-a-service (SaaS) information product that monitors publicly available travel pricing data — including Business Class and, depending on the products you purchase, First Class airfare, domestic premium-cabin airfare, hotel rates, airport lounge pricing, and private jet empty-leg availability — and sends email notifications ("alerts") when our algorithms detect prices that appear to be below historical averages or otherwise noteworthy.
2.2 What FlyAlerts Is Not
FlyAlerts is not a travel agency, airline, ticket broker, ticket reseller, hotel operator, charter operator, or booking platform. Except as expressly described in Section 2.5 (Concierge Access), we do not:
- Sell, book, reserve, or guarantee airline tickets, seats, hotel rooms, lounge access, or private jet flights
- Act as an agent, broker, or intermediary for any airline, hotel, lounge operator, jet operator, or travel provider
- Guarantee the accuracy, availability, or validity of any fare, rate, or price
- Have any control over provider pricing, inventory, availability, fare or rate rules, or booking conditions
- Process, handle, or facilitate any travel transaction or reservation
2.3 No Airline or Travel Provider Affiliation
FlyAlerts is an independent company and is not affiliated with, endorsed by, sponsored by, or associated with any airline, airline alliance, hotel, hotel group, lounge operator, private jet or charter operator, travel agency, or booking platform. All names, logos, and trademarks displayed on our website or in our alerts are the property of their respective owners and are used solely for informational identification purposes. Their display does not imply any partnership, endorsement, or affiliation.
2.4 Products and Add-Ons
The Service is offered as Base Plans and optional Add-Ons:
- Base Plans — the Solo Plan (Business Class fare alerts from your home airport for one traveler), the Couple Plan (alerts checked for two seats together), and the Family Plan (group-availability alerts for up to five travelers).
- Enhanced — an upgrade extending your alerts to include First Class fares, domestic US premium-cabin routes, an unlimited number of monitored departure airports, priority delivery of limited-availability deals, custom alert filters (cabin, budget, destinations), and premium lounge deal alerts.
- Hotel Deals — email alerts for 4-star and 5-star hotel price drops at destinations relevant to your alerts.
- Concierge Access — a referral service granting you the ability to request off-market fare searches performed by an independent third-party partner, as described in Section 2.5.
- Private Jet Deals — email alerts for empty-leg private jet flight availability offered by third-party operators.
- Nearby Airport Monitoring — fare monitoring extended to airports located near your designated home airport.
Unless expressly stated otherwise, all Base Plans and Add-Ons are informational alert services only, and every reference in these Terms to "fares," "prices," or "alerts" applies equally to airfare, hotel rates, lounge pricing, and private jet pricing. We may add, modify, rename, or discontinue individual products or features over time; material changes will not reduce the core alert service of a plan you have already paid for during its active service period.
2.5 Concierge Access — Independent Third-Party Partner
The Concierge Access fee covers access to our concierge referral service only — that is, connecting you with an independent third-party partner who performs off-market fare searches based on the preferences you submit. The fee does not purchase, and does not entitle you to, any specific fare, search result, ticket, or booking outcome.
You acknowledge and agree that:
- Once we have connected you with the partner, the search and any resulting booking services are provided entirely by the partner, not by Fly Alerts LLC;
- The partner operates independently, is not our agent, employee, or affiliate, and is solely responsible for its fare searches, pricing, any additional charges it may impose, bookings, ticketing, customer support, and the results of your requests;
- Fly Alerts LLC has no control over, and accepts no responsibility or liability for, the partner's services, conduct, availability, pricing, or outcomes;
- Results are not guaranteed. Whether a suitable fare can be found depends on your route, travel dates, cabin, and current inventory, all of which are outside our control. Short-haul, domestic, or last-minute requests may have limited or no availability;
- Tickets booked through the partner are non-refundable and are subject to the partner's own terms and the fare rules attached to the ticket. Any refund, change, or cancellation request relating to such a ticket must be directed to the partner, not to Fly Alerts LLC;
- The Concierge Access fee itself is final and non-refundable, as set out in Section 6 and our Refund Policy;
- Any dispute arising from the partner's services is between you and the partner. You agree to pursue such disputes directly with the partner and not against Fly Alerts LLC.
3. Eligibility
To use FlyAlerts, you must: (a) be at least 18 years of age; (b) be a legal resident of the United States; (c) have the legal capacity to enter into a binding contract; and (d) not be prohibited from using the Service under any applicable law. By creating an account, you represent and warrant that you meet all eligibility requirements.
4. Account Registration and Security
To access the Service, you must create an account by providing a valid email address, your preferred departure airport (IATA code), and a secure password. You are solely responsible for: (a) maintaining the confidentiality of your login credentials; (b) all activity that occurs under your account; and (c) notifying us immediately at support@fly-alerts.com if you suspect unauthorized access. We reserve the right to suspend or terminate accounts that appear to be compromised.
5. Payment Terms
5.1 Pricing
Base Plans are offered as a one-time payment for a 12-month service period. Add-Ons are offered as one-time payments that apply for the duration of your active service period unless otherwise stated at the time of purchase. There are no recurring charges, automatic renewals, or hidden fees. All prices are in US Dollars (USD) and subject to change; however, price changes will not affect purchases you have already made. Promotional pricing (including new-member or single-page offers) may differ from standard pricing and may be available only at specified times or on specified pages.
5.2 Payment Processing
All payments are processed securely by Stripe, Inc., a PCI-DSS Level 1 certified payment processor. FlyAlerts does not collect, store, process, or have access to your full credit or debit card number, CVV, or billing details. Your payment relationship for card processing is directly with Stripe, subject to Stripe's own terms and privacy policy.
5.3 Taxes
Prices may be exclusive of applicable sales tax, use tax, or similar transaction taxes. You are responsible for any taxes applicable in your jurisdiction.
6. Refund Policy
We offer a 30-day money-back guarantee on Base Plans (Solo, Couple, and Family) from the date of purchase. Contact us at support@fly-alerts.com within 30 calendar days of your purchase date for a full refund of the Base Plan price to your original payment method.
Add-On Purchases — including Enhanced, Hotel Deals, Concierge Access, Private Jet Deals, and Nearby Airport Monitoring — are final at the time of purchase and are non-refundable, whether purchased together with a Base Plan or separately. This is disclosed on our pricing pages and before checkout. If you purchase a Base Plan together with one or more Add-Ons and request a refund within the 30-day window, only the Base Plan portion of your payment will be refunded.
After 30 days, all purchases are final and non-refundable. See our full Refund Policy for details. Nothing in this section limits any non-waivable rights you may have under applicable consumer protection law.
7. No Guarantees — Informational Service Only
You acknowledge and agree that:
- Airfare, hotel rates, lounge pricing, and private jet pricing are set exclusively by the respective providers and are subject to change at any time without notice
- A price displayed in an alert may no longer be available by the time you attempt to book
- Percentage savings and price comparisons in alerts and on our website — including statements such as "up to 90% off charter price" — are estimates based on historical data or typical published rates and do not constitute guarantees of actual savings
- Many factors outside our control affect pricing, including but not limited to: dynamic pricing algorithms, inventory, travel dates, booking or rate class, routing, demand, currency fluctuations, taxes, fees, and surcharges
- You are solely responsible for verifying all pricing, rules, and terms directly with the airline, hotel, lounge operator, jet operator, or other provider before purchasing
- We do not guarantee any specific number or frequency of alerts, and comparative statements about alert volume or average discounts across products are historical averages, not promises of future results
- FlyAlerts shall not be liable for any financial loss, missed opportunity, or booking decision made based on our alerts or on any search performed by the Concierge Access partner
8. Intellectual Property
All content on the FlyAlerts website and Service — including text, graphics, logos, icons, images, software, algorithms, data compilations, and the overall design — is the property of Fly Alerts LLC or its licensors and is protected by US and international copyright, trademark, and intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any content without our prior written consent.
Airline, hotel, lounge, and operator names, logos, and trademarks that appear on our website or in alerts are the property of their respective owners and are used solely for factual identification. Their use does not imply any affiliation or endorsement.
9. Prohibited Uses
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law
- Reverse-engineer, decompile, disassemble, or attempt to derive the source code of our software or algorithms
- Scrape, data-mine, crawl, or use automated systems to access or collect data from the Service
- Share, resell, sublicense, or redistribute your account access, alert data, or Concierge Access referrals
- Interfere with or attempt to compromise the integrity or performance of the Service
- Impersonate any person or entity, or misrepresent your affiliation
- Use the Service to develop or operate a competing product or service
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. To the fullest extent permitted by law, FlyAlerts disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and any warranties arising from course of dealing or usage of trade.
We do not warrant that: (a) the Service will meet your expectations; (b) the Service will be uninterrupted, timely, secure, or error-free; (c) pricing information will be accurate, complete, current, or available at the time of booking; (d) defects will be corrected; (e) use of the Service will result in any particular savings or financial outcome; or (f) the Concierge Access partner will locate any fare or complete any booking.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLY ALERTS LLC, ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — including damages for loss of profits, revenue, data, goodwill, or other intangible losses — arising from: (a) your use of or inability to use the Service; (b) any pricing information or alert provided through the Service; (c) any booking decision or transaction made based on our alerts; (d) unauthorized access to your account; (e) the acts, omissions, services, pricing, or bookings of the independent Concierge Access partner or any other third-party provider; or (f) any other matter related to the Service.
OUR TOTAL AGGREGATE LIABILITY for all claims shall not exceed the amount you paid to FlyAlerts in the twelve (12) months preceding the claim, or fifty US dollars ($50.00), whichever is greater.
These limitations apply regardless of legal theory — contract, tort (including negligence), strict liability, or otherwise — even if FlyAlerts has been advised of the possibility of such damages.
12. Indemnification
You agree to indemnify, defend, and hold harmless Fly Alerts LLC and its officers, directors, members, employees, agents, and affiliates from any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your breach of these Terms; (c) your violation of any law or regulation; (d) any booking, transaction, or decision you make based on our alerts; or (e) any dispute between you and the Concierge Access partner, an airline, a hotel, a jet operator, or any other third-party travel provider.
13. Third-Party Services and Links
Our Service may contain links to third-party websites, including airline, hotel, lounge, and jet-operator booking pages, and may refer you to independent third-party service providers, including the Concierge Access partner described in Section 2.5. These links and referrals are provided for convenience only. FlyAlerts has no control over and assumes no responsibility for the content, privacy policies, practices, availability, pricing, or accuracy of any third-party site or provider. Your use of third-party sites and services is governed exclusively by their own terms.
14. Service Availability and Modifications
We reserve the right to modify, suspend, or discontinue the Service (or any part) at any time, with or without notice. We shall not be liable for any modification, suspension, or discontinuation. We do not guarantee any specific number or frequency of alerts during your service period.
15. Termination
We may suspend or terminate your account at our sole discretion, without prior notice, if: (a) you breach these Terms; (b) required by law; (c) we reasonably believe your account is compromised; or (d) we discontinue the Service. You may close your account at any time by contacting us. Upon termination, Sections 7–12 and 16–18 shall survive.
16. Dispute Resolution and Arbitration
Any dispute arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation by contacting legal@fly-alerts.com. If unresolved within 30 days, either party may initiate binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules in Sheridan County, Wyoming. You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action.
17. Governing Law
These Terms shall be governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles. To the extent litigation is permitted, you consent to the exclusive jurisdiction of courts in Sheridan County, Wyoming.
18. General Provisions
Entire Agreement. These Terms, together with our Privacy Policy, Cookie Policy, Disclaimer, and Refund Policy, constitute the entire agreement between you and FlyAlerts.
Severability. If any provision is found unenforceable, the remaining provisions continue in full force.
Waiver. Failure to enforce any right or provision shall not constitute a waiver.
Assignment. You may not assign these Terms without our consent. We may assign without restriction.
Force Majeure. We shall not be liable for failures due to circumstances beyond our reasonable control, including acts of God, natural disasters, pandemics, war, terrorism, government actions, or third-party service failures.
Notices. We may notify you via the email associated with your account.
