These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Fly Alerts LLC, a Wyoming limited liability company ("FlyAlerts," "Company," "we," "us," or "our"), with its principal office at 75 E 3rd St, Ste 7, Sheridan, WY 82801.
By accessing our website at flyalerts.com, creating an account, or purchasing our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, our Cookie Policy, and our Disclaimer, all of which are incorporated herein by reference.
FlyAlerts is a software-as-a-service (SaaS) information product that monitors publicly available Business Class airfare data and sends email notifications ("alerts") to subscribers when our algorithms detect prices that appear to be below historical averages for a given route.
FlyAlerts is not a travel agency, airline, ticket broker, ticket reseller, or booking platform. We do not:
FlyAlerts is an independent company and is not affiliated with, endorsed by, sponsored by, or associated with any airline, airline alliance, travel agency, or booking platform. All airline names, logos, and trademarks displayed on our website or in our alerts are the property of their respective owners and are used solely for informational identification purposes. The display of airline names or logos does not imply any partnership, endorsement, or affiliation.
To use FlyAlerts, you must: (a) be at least 18 years of age; (b) be a legal resident of the United States; (c) have the legal capacity to enter into a binding contract; and (d) not be prohibited from using the Service under any applicable law. By creating an account, you represent and warrant that you meet all eligibility requirements.
To access the Service, you must create an account by providing a valid email address, your preferred departure airport (IATA code), and a secure password. You are solely responsible for: (a) maintaining the confidentiality of your login credentials; (b) all activity that occurs under your account; and (c) notifying us immediately at support@flyalerts.com if you suspect unauthorized access. We reserve the right to suspend or terminate accounts that appear to be compromised.
FlyAlerts is offered as a one-time payment for a 12-month service period. There are no recurring charges, automatic renewals, or hidden fees. All prices are in US Dollars (USD) and subject to change; however, price changes will not affect existing paid subscriptions.
All payments are processed securely by Stripe, Inc., a PCI-DSS Level 1 certified payment processor. FlyAlerts does not collect, store, process, or have access to your full credit or debit card number, CVV, or billing details. Your payment relationship for card processing is directly with Stripe, subject to Stripe's own terms and privacy policy.
Prices may be exclusive of applicable sales tax, use tax, or similar transaction taxes. You are responsible for any taxes applicable in your jurisdiction.
We offer a 30-day money-back guarantee from the date of purchase. Contact us at support@flyalerts.com within 30 calendar days of your purchase date for a full refund to your original payment method. After 30 days, all purchases are final and non-refundable. See our full Refund Policy for details.

All content on the FlyAlerts website and Service — including text, graphics, logos, icons, images, software, algorithms, data compilations, and the overall design — is the property of Fly Alerts LLC or its licensors and is protected by US and international copyright, trademark, and intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any content without our prior written consent.
Airline names, logos, and trademarks that appear on our website or in alerts are the property of their respective owners and are used solely for factual identification. Their use does not imply any affiliation or endorsement.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. To the fullest extent permitted by law, FlyAlerts disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and any warranties arising from course of dealing or usage of trade.
We do not warrant that: (a) the Service will meet your expectations; (b) the Service will be uninterrupted, timely, secure, or error-free; (c) fare information will be accurate, complete, current, or available at the time of booking; (d) defects will be corrected; or (e) use of the Service will result in any particular savings or financial outcome.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLY ALERTS LLC, ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — including damages for loss of profits, revenue, data, goodwill, or other intangible losses — arising from: (a) your use of or inability to use the Service; (b) any fare information or alert provided through the Service; (c) any booking decision or transaction made based on our alerts; (d) unauthorized access to your account; or (e) any other matter related to the Service.
OUR TOTAL AGGREGATE LIABILITY for all claims shall not exceed the amount you paid to FlyAlerts in the twelve (12) months preceding the claim, or fifty US dollars ($50.00), whichever is greater.
These limitations apply regardless of legal theory — contract, tort (including negligence), strict liability, or otherwise — even if FlyAlerts has been advised of the possibility of such damages.
You agree to indemnify, defend, and hold harmless Fly Alerts LLC and its officers, directors, members, employees, agents, and affiliates from any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your breach of these Terms; (c) your violation of any law or regulation; or (d) any booking, transaction, or decision you make based on our alerts.
Our Service may contain links to third-party websites, including airline booking pages. These links are provided for convenience only. FlyAlerts has no control over and assumes no responsibility for the content, privacy policies, practices, availability, or accuracy of any third-party site. Your use of third-party sites is governed by their own terms.
We reserve the right to modify, suspend, or discontinue the Service (or any part) at any time, with or without notice. We shall not be liable for any modification, suspension, or discontinuation. We do not guarantee any specific number or frequency of alerts during your subscription.
We may suspend or terminate your account at our sole discretion, without prior notice, if: (a) you breach these Terms; (b) required by law; (c) we reasonably believe your account is compromised; or (d) we discontinue the Service. You may close your account at any time by contacting us. Upon termination, Sections 7–12 and 16–18 shall survive.
Any dispute arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation by contacting legal@flyalerts.com. If unresolved within 30 days, either party may initiate binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules in Sheridan County, Wyoming. You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action.
These Terms shall be governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles. To the extent litigation is permitted, you consent to the exclusive jurisdiction of courts in Sheridan County, Wyoming.
Entire Agreement. These Terms, together with our Privacy Policy, Cookie Policy, Disclaimer, and Refund Policy, constitute the entire agreement between you and FlyAlerts.
Severability. If any provision is found unenforceable, the remaining provisions continue in full force.
Waiver. Failure to enforce any right or provision shall not constitute a waiver.
Assignment. You may not assign these Terms without our consent. We may assign without restriction.
Force Majeure. We shall not be liable for failures due to circumstances beyond our reasonable control, including acts of God, natural disasters, pandemics, war, terrorism, government actions, or third-party service failures.
Notices. We may notify you via the email associated with your account.
