Please read this Disclaimer carefully. By using FlyAlerts, you acknowledge that you have read, understood, and agree to the terms set forth below. If you do not agree, do not use our Service.

1. Informational Service Only

FlyAlerts is a software-as-a-service (SaaS) information product that monitors publicly available travel pricing data — including Business Class and, depending on the products you purchase, First Class airfare, domestic premium-cabin airfare, hotel rates, airport lounge pricing, and private jet empty-leg availability — and sends email alerts when our algorithms detect prices that appear to be below historical averages. The information provided through our Service — including prices, percentage comparisons, route data, and provider information — is for general informational purposes only and is provided in good faith.

FlyAlerts does not sell, book, reserve, hold, or guarantee airline tickets, seats, fares, hotel rooms, lounge access, or private jet flights. We do not act as a travel agency, airline, hotel operator, charter operator, ticket broker, ticket reseller, or booking intermediary in any capacity. The sole exception to our purely informational role is the Concierge Access referral service described in Section 4, in which the underlying services are performed by an independent third-party partner, not by us.

2. No Guarantee of Savings, Discounts, or Pricing

Critical: We do not and cannot guarantee that you will save money, receive a discount, or obtain any specific fare, rate, or price by using FlyAlerts. Airfare, hotel, lounge, and private jet pricing is entirely outside our control.

You expressly acknowledge and agree that:

No guaranteed savings: The price comparisons, potential savings, percentage discounts, and "deal" designations on our website and in our alerts — including statements such as "up to 90% off charter price" for Private Jet Deals — are estimates only, derived from historical data analysis or comparisons with typical published rates. They do not represent guarantees of any specific savings, discounts, or pricing outcomes.
Prices change constantly: Airfare is set exclusively by airlines and their distribution systems; hotel rates by hotels and their distribution channels; lounge pricing by lounge operators; and private jet pricing by charter operators. All such prices are subject to change at any time, without notice, and may change between the time we detect a price and the time you attempt to book.
Historical comparisons are estimates: Our "percentage below average" calculations are based on historical data models. Historical averages are approximations and may not reflect current market conditions, seasonal patterns, or fare, rate, or cabin class differences.
Many uncontrollable factors affect pricing: Actual availability and pricing depend on numerous factors entirely beyond our control, including but not limited to: dynamic pricing algorithms, real-time inventory, travel dates, booking class, fare or rate class, routing and connections, demand, currency exchange rates, fuel surcharges, government taxes and fees, airport and resort charges, and provider promotional decisions.
Prices may not be available: A fare, rate, or price shown in an alert may no longer be available, may be sold out, may have different terms than expected, or may require specific conditions (e.g., advance purchase, minimum stay) that are not reflected in the alert.
Your responsibility to verify: You are solely and exclusively responsible for verifying all pricing, fare and rate rules, terms and conditions, availability, baggage policies, change/cancellation policies, and any other relevant information directly with the airline, hotel, lounge operator, jet operator, or other provider before making any purchase or booking decision.

3. No Affiliation with Airlines or Travel Providers

FlyAlerts is an independent company. We are not affiliated with, endorsed by, sponsored by, partnered with, or associated with any airline, airline alliance (including but not limited to Star Alliance, SkyTeam, or oneworld), hotel, hotel group, lounge operator, private jet or charter operator, travel agency, online travel agency (OTA), booking platform, or travel service provider.

Any airline, hotel, lounge, operator, or other provider names, logos, trademarks, service marks, or trade names displayed on our website, in our marketing materials, or in our email alerts are the sole property of their respective owners. Their use on our website and in our alerts is strictly for informational and factual identification purposes only under principles of nominative fair use. Such use does not imply:

Any commercial partnership, affiliation, or business relationship
Any endorsement or sponsorship by any airline, hotel, or travel provider
Any authorization by any provider to sell, distribute, or broker their tickets, rooms, or flights
Any agency relationship of any kind

4. Concierge Access — Independent Third-Party Partner

Off-market fare searches offered through our Concierge Access product are performed by an independent third-party partner, not by Fly Alerts LLC. Our role is limited to connecting you with the partner. The partner is not our agent, employee, or affiliate, and Fly Alerts LLC does not perform, supervise, control, or guarantee the partner's searches, pricing, bookings, availability, or results.

Whether a suitable fare can be found depends on your route, travel dates, cabin, and current inventory — all outside our control — and no result is guaranteed. Tickets booked through the partner are subject to the partner's own terms and the fare rules attached to the ticket, and are non-refundable. Any statement on our website describing the Concierge service or example results reflects the partner's past performance and does not guarantee future outcomes. See Section 2.5 of our Terms of Service and Section 3 of our Refund Policy for the full terms governing Concierge Access.

5. No Professional Advice

Nothing on our website or in our alerts constitutes professional financial advice, investment advice, travel advice, or legal advice. FlyAlerts does not provide recommendations on whether you should purchase any particular fare, rate, or flight. Any reliance you place on information from our Service is strictly at your own risk. We recommend consulting with a qualified professional for financial or travel planning decisions.

6. Third-Party Websites, Links, and Providers

Our alerts and website may contain links to third-party websites — including but not limited to airline, hotel, lounge, and jet-operator booking pages, travel search engines, and other external resources — and may refer you to independent third-party service providers, including the Concierge Access partner. These links and referrals are provided solely for your convenience and do not constitute an endorsement, recommendation, or guarantee of any third-party product, service, or content.

FlyAlerts has no control over and assumes no responsibility for the content, accuracy, privacy policies, practices, availability, pricing, terms of service, or any other aspect of third-party websites or providers. You access third-party websites and use third-party services at your own risk, and your interactions with them are governed exclusively by their own terms and policies.

7. Accuracy of Information

While we make reasonable efforts to provide accurate and timely pricing information, we make no representation or warranty of any kind, express or implied, regarding the accuracy, adequacy, validity, reliability, availability, completeness, or timeliness of any information provided through our Service. Pricing data is sourced from third-party providers and may contain errors, be delayed, or be incomplete.

8. Testimonials and Reviews

Any testimonials, reviews, user stories, or case studies displayed on our website or marketing materials reflect the individual, personal experiences and opinions of specific users. They are not intended to represent or guarantee that any current or future user will achieve the same or similar results, savings, or experiences. Individual outcomes vary significantly based on factors including departure airport, travel dates, destinations, booking timing, and provider availability.

9. AI and Algorithmic Systems

FlyAlerts uses artificial intelligence and algorithmic systems to analyze pricing data and detect anomalies. These systems are automated and may produce imperfect results. Our algorithms may occasionally: (a) miss relevant price drops; (b) flag prices that are not actually below average; (c) produce inaccurate historical comparisons; or (d) experience delays or outages. We do not guarantee the performance, accuracy, or reliability of our algorithmic systems.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FLY ALERTS LLC AND ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES arising out of or in connection with:

Your use of or inability to use the Service
Any fare, rate, price, or availability information provided through the Service
Any booking, purchase, or financial transaction you make (or fail to make) based on information from the Service
Any errors, inaccuracies, or omissions in pricing data or alerts
The acts, omissions, services, pricing, or bookings of the independent Concierge Access partner or any other third-party provider
Any interaction with airlines, hotels, lounge operators, jet operators, travel providers, or third-party websites accessed through the Service
Service interruptions, delays, or outages
Any other matter related to the Service

This limitation applies regardless of legal theory — whether based on contract, tort (including negligence), strict liability, warranty, or any other theory — and even if FlyAlerts has been advised of the possibility of such damages.

11. Assumption of Risk

By using FlyAlerts, you expressly acknowledge and agree that you assume all risk associated with your use of the Service and any decisions you make based on the information provided, including any decision to book non-refundable travel through the independent Concierge Access partner. You understand that airfare, hotel, lounge, and private jet pricing is volatile, unpredictable, and subject to factors entirely outside anyone's control, and that no information service can guarantee specific pricing outcomes.

12. Regulatory Compliance

FlyAlerts is not a regulated travel agency, airline, or financial institution. We are a software information service. We are not subject to, and do not hold any licenses under, the regulations governing airlines, travel agents, or ticket sellers. We are not registered with the Airlines Reporting Corporation (ARC), the International Air Transport Association (IATA), or any state or federal travel seller registration program, as our Service does not involve the sale or distribution of airline tickets. Any ticketing or booking performed by the independent Concierge Access partner is conducted by the partner under its own authorizations and responsibilities, not ours.

13. Indemnification

You agree to indemnify, defend, and hold harmless Fly Alerts LLC and its officers, directors, members, employees, agents, and affiliates from any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) any booking, purchase, or transaction you make based on our alerts or through the Concierge Access partner; (c) your violation of these Terms or any applicable law; or (d) any dispute between you and the Concierge Access partner, an airline, a hotel, a jet operator, or any other third-party travel provider.

14. Severability

If any provision of this Disclaimer is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable while preserving its original intent.
