1. Informational Service Only

FlyAlerts is a software-as-a-service (SaaS) information product that monitors publicly available airfare data and sends email alerts when our algorithms detect prices that appear to be below historical averages. The information provided through our Service — including fare prices, percentage comparisons, route data, and airline information — is for general informational purposes only and is provided in good faith.

FlyAlerts does not sell, book, reserve, hold, or guarantee airline tickets, seats, or fares. We do not act as a travel agency, airline, ticket broker, ticket reseller, or booking intermediary in any capacity.

2. No Guarantee of Savings, Discounts, or Pricing

Critical: We do not and cannot guarantee that you will save money, receive a discount, or obtain any specific fare by using FlyAlerts. Airfare pricing is entirely outside our control.

You expressly acknowledge and agree that:

No guaranteed savings: The price comparisons, potential savings, percentage discounts, and "deal" designations on our website and in our alerts are estimates only, derived from historical fare data analysis. They do not represent guarantees of any specific savings, discounts, or pricing outcomes.
Prices change constantly: Airfare prices are set exclusively by airlines and their distribution systems. Prices are subject to change at any time, without notice, and may change between the time we detect a fare and the time you attempt to book.
Historical comparisons are estimates: Our "percentage below average" calculations are based on historical data models. Historical averages are approximations and may not reflect current market conditions, seasonal patterns, or fare class differences.
Many uncontrollable factors affect pricing: Actual fare availability and pricing depend on numerous factors entirely beyond our control, including but not limited to: airline dynamic pricing algorithms, real-time seat inventory, travel dates, booking class and fare class, routing and connections, passenger demand, currency exchange rates, fuel surcharges, government taxes and fees, airport charges, and airline promotional decisions.
Fares may not be available: A fare shown in an alert may no longer be available, may be sold out, may have different terms than expected, or may require specific conditions (e.g., advance purchase, minimum stay) that are not reflected in the alert.
Your responsibility to verify: You are solely and exclusively responsible for verifying all pricing, fare rules, terms and conditions, availability, baggage policies, change/cancellation policies, and any other relevant information directly with the airline before making any purchase or booking decision.

3. No Affiliation with Airlines or Travel Providers

FlyAlerts is an independent company. We are not affiliated with, endorsed by, sponsored by, partnered with, or associated with any airline, airline alliance (including but not limited to Star Alliance, SkyTeam, or oneworld), travel agency, online travel agency (OTA), booking platform, or travel service provider.

Any airline names, logos, trademarks, service marks, or trade names displayed on our website, in our marketing materials, or in our email alerts are the sole property of their respective owners. Their use on our website and in our alerts is strictly for informational and factual identification purposes only under principles of nominative fair use. Such use does not imply:

Any commercial partnership, affiliation, or business relationship
Any endorsement or sponsorship by any airline or travel provider
Any authorization by any airline to sell, distribute, or broker their tickets
Any agency relationship of any kind

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FLY ALERTS LLC AND ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES arising out of or in connection with:

Your use of or inability to use the Service
Any fare, price, or availability information provided through the Service
Any booking, purchase, or financial transaction you make (or fail to make) based on information from the Service
Any errors, inaccuracies, or omissions in fare data or alerts

This limitation applies regardless of legal theory — whether based on contract, tort (including negligence), strict liability, warranty, or any other theory — and even if FlyAlerts has been advised of the possibility of such damages.

10. Assumption of Risk

By using FlyAlerts, you expressly acknowledge and agree that you assume all risk associated with your use of the Service and any decisions you make based on the information provided. You understand that airfare pricing is volatile, unpredictable, and subject to factors entirely outside anyone's control, and that no information service can guarantee specific pricing outcomes.

11. Regulatory Compliance

FlyAlerts is not a regulated travel agency, airline, or financial institution. We are a software information service. We are not subject to, and do not hold any licenses under, the regulations governing airlines, travel agents, or ticket sellers. We are not registered with the Airlines Reporting Corporation (ARC), the International Air Transport Association (IATA), or any state or federal travel seller registration program, as our Service does not involve the sale or distribution of airline tickets.

12. Indemnification

You agree to indemnify, defend, and hold harmless Fly Alerts LLC and its officers, directors, members, employees, agents, and affiliates from any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) any booking, purchase, or transaction you make based on our alerts; (c) your violation of these Terms or any applicable law; or (d) any dispute between you and an airline or third-party travel provider.

13. Severability

If any provision of this Disclaimer is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable while preserving its original intent.
